Ekta Fitness – Customer Terms & Conditions

These Terms & Conditions (“Terms”) explain the rules for booking and attending fitness classes through Ekta Fitness. Please read them carefully before booking. By booking or attending a class, you agree to these Terms.

1. Bookings

1.1. All class bookings must be made through our booking partner, GymCatch.
1.2. A booking is only confirmed once full payment has been received.
1.3. You must bring proof of your booking (confirmation email or GymCatch app booking) and show it to the instructor at the start of the class.

2. Eligibility

2.1. You must be 18 years or older to book and attend a class.
2.2. By booking, you confirm you meet this requirement.

3. Cancellation, Refunds, and Class Credits

3.1 Customers who cancel a class at least 24 hours before the scheduled start time will automatically receive a class credit applied to their account, which may be used for future bookings through the platform.
3.2 For online bookings within 14 days of purchase, customers are entitled to request a full cash refund instead of a class credit, in accordance with UK consumer law. Requests must be submitted by email to cancellations@ektafitness.com, and refunds will be issued to the original payment method.
3.3 Cancellations made less than 24 hours before the class and 14 days after purchase will not be eligible for a class credit.
3.4 If Ekta Fitness cancels a class, customers will receive either a refund or a class credit at the discretion of the business.
3.5 Use of Class Credits:

  • Credits may only be redeemed for future bookings through the platform and cannot be exchanged for cash, except where statutory rights apply or the business expressly allows.

  • Credits are valid for 6 months from the date of issue. Expired credits will not be refundable.

  • Credits are non-transferable to other accounts unless expressly permitted by the business.

  • Credits must be applied at the time of booking, and the business reserves the right to refuse redemption if a credit has expired, been used, or is otherwise invalid.

3.6 This policy is designed to be fair, transparent, and compliant with UK consumer law, including statutory cooling-off rights. Customers are encouraged to review the policy carefully and contact cancellations@ektafitness.com with any questions.

4. Health, Safety & Participation

4.1. Participation in fitness activities involves risk of injury or illness. By booking and attending a class, you confirm that:

  • You are in good health and physically able to take part.

  • You are responsible for your own health and safety during the class.

  • You have considered any medical advice relevant to your participation.

4.2. You must inform the instructor before the class if you have any injuries, medical conditions, or limitations that may affect your ability to take part safely.

4.3. You agree to follow the instructor’s instructions during the class.

4.4. Neither Ekta Fitness nor the instructor can guarantee that participation is free from risk.

 

4.5. By booking and attending a class, you confirm that you have voluntarily chosen to participate and you accept full responsibility for any risks, injuries, or damages you may experience, to the maximum extent permitted by law.

4.6. Ekta Fitness and instructors are not responsible for the loss, theft, or damage of personal belongings brought to classes. You are advised not to bring valuables.

5. Instructors

5.1. Instructors operate as independent providers, not employees of Ekta Fitness.
5.2. Ekta Fitness is not responsible for the actions, omissions, or conduct of instructors.

5.3. Ekta Fitness is not liable for the acts, omissions, or conduct of instructors.

6. Data Protection & Privacy

6.1. We collect and process personal data (such as your name, contact details, booking information, and any health declarations you provide) in line with UK data protection law (including the UK GDPR).
6.2. We may share limited information (such as your name and booking details) with instructors so they can deliver the class.

6.4. You have legal rights over your personal data, including the right to access, correct, delete, or restrict its use, and the right to lodge a complaint with the Information Commissioner’s Office (ICO).

7. Photography & Social Media

7.1. Sometimes we may take photos or videos of classes for marketing or social media use.
7.2. If this is planned, we will tell you in advance.
7.3. You can opt out by telling us or the instructor before the class begins.

8. Liability

8.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law.

8.2. Subject to 8.1, Ekta Fitness is not liable for:

  • Any injury, illness, or medical condition arising from participation in a class.

  • Any loss, damage, or costs you may suffer as a result of attending a class.

  • The behaviour or conduct of instructors or other participants.

8.3. To the maximum extent permitted by law, any liability of Ekta Fitness in connection with a class will be limited to the total amount paid by you for that class.

9. Changes to Terms

9.1. We may update these Terms from time to time.
9.2. The version in place at the time of your booking applies to that booking.

10. Governing Law

10.1. These Terms are governed by the laws of England and Wales.
10.2. Any disputes will be dealt with exclusively in the courts of England and Wales.
